It appears that Nintendo has taken action against any Discord community associated with Switch emulators. Reports suggest that Discord is removing servers for the Nintendo Switch emulators Suyu and Sudachi, and also disabling the accounts of their respective developers.
According to The Verge, developers of certain emulators were contacted by Discord for allegedly sharing content that violates intellectual property. Discord issued a statement, mentioning that a court-ordered injunction was issued to take down such materials. This suggests that the action is related to previous legal issues surrounding the Yuzu Switch emulator.
“Discord responds to and complies with all legal and valid Digital Millennium Copyright Act (DMCA) requests. In this instance, there was also a court ordered injunction for the takedown of these materials, and we took action in a manner consistent with the court order.”
It is uncertain whether the Discord channels were infringing on any intellectual property rights. Although the developers asserted that they were implementing necessary precautions to prevent any legal repercussions from Nintendo, it is conceivable that certain members within the channels were exchanging content that could potentially violate Discord’s policies.
Discord’s Copyright and IP Policy states that they will remove only the content that is deemed to be infringing on copyright law, while repeat offenders’ accounts will be disabled entirely. However, Sudachi’s developer Jarrod Norwell claimed that Discord removed his account suddenly without providing sufficient information to justify their action.
It appears that Discord’s decision to remove entire channels and developer accounts is a way of covering all their bases and avoiding any potential conflict with Nintendo. It seems like Nintendo is taking a strong stance against Switch emulators, and Discord would rather not provoke their ire. Hopefully, more information will be revealed about this issue in the future.
